1. Acceptance of Terms

By accessing or using drinkh2pro.com (the "Site") or by providing your mobile phone number to us, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site or submit your information.

2. Eligibility

You must be at least 18 years old to use the Site or enroll in our text messaging program. Our Sites are not intended for use for individuals under 18 years of age and we do not intend to advertise to children 16 years on any media channels in which age targeting is possible. 

3. The Site and Products

The Protein Water Company ("we," "us," "our") operates the Site to provide information about and sell H2Pro+ Protein Water products, clothing and accessories. We reserve the right to modify or discontinue the Site or any product at any time without notice.

4. SMS/Text Message Marketing Program

a. Consent. By providing your mobile phone number and opting in, you expressly consent to receive recurring automated marketing and promotional text messages (including via an automatic telephone dialing system) from us at the number provided. Consent is not a condition of any purchase.

b. Message frequency. Message frequency varies. We reserve the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages.

c. Message and data rates. Message and data rates may apply, charged by your mobile carrier.

d. Opt-out. You may cancel at any time by replying STOP to any message. You will receive a confirmation, after which we will send no further marketing texts. For help, reply HELP or contact us at customerservice@drinkh2pro.com. 

e. Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers may change.

f. No guarantee of delivery. We do not guarantee that messages will be delivered or that the program will be uninterrupted or error-free.

5. Privacy

Your information is handled per our Privacy Policy. We do not sell or share your mobile phone number or opt-in data with third parties for their own marketing purposes.

6. Intellectual Property

All content on the Site is owned by us or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. Prohibited Conduct

You agree not to use the Site unlawfully, to interfere with its operation, or to submit false information.

8. Disclaimers

The Site and products are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, The Protein Water Company is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or the text messaging program.

10. Indemnification

You agree to indemnify and hold The Protein Water Company harmless from claims arising out of your use of the Site or violation of these Terms.

11. Governing Law / Dispute Resolution

These Terms are governed by the laws of New York, without regard to conflict-of-law rules.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
